Terms of Service
The agreement governing QuizTell content, AI generation, game results, local progress, future accounts, advertising and acceptable use.
1. Introduction and acceptance
These Terms of Service (“Terms”) govern your access to and use of QuizTell at quiztell.com, including the website, permanent quiz library, Daily Quiz, AI Quiz, game modes, progress and backup features, account and contact interfaces, and related pages, content and services (collectively, the “Service”).
By accessing or using the Service, starting a quiz, submitting an AI Quiz request, importing progress, or selecting a control that accepts these Terms, you agree to be bound by these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the Service.
If a separate written agreement signed by the Service operator expressly governs a feature, that agreement controls only to the extent of a direct conflict. Additional rules displayed for a particular feature form part of these Terms when you use that feature.
2. The operator, the Service, and contact status
In these Terms, “QuizTell,” “we,” “us,” and “our” refer to the operator of the Service. “You” refers to the person using the Service and, where applicable, the organization that person is authorized to represent.
Questions, corrections, rights complaints, and legal notices may be submitted through the Contact Us page when message delivery is available. The page reports its current delivery status. A submission attempt that returns an unavailable or not-configured message has not been delivered, and you should not assume we received it.
We will publish the operator's legal identity, service address, and operational legal and privacy contact before offering the Service generally in a market that requires those details.
The Service may remain in development, testing, private preview, or pre-launch while pages are accessible. A visible interface, planned-feature description, or legal clause does not itself mean that the feature is enabled, generally available, or suitable for production use.
3. Eligibility, minors, and authority
You must be at least 13 years old and must also meet any higher minimum age required where you live to use an online service or provide your own consent. If you are under the age of legal majority where you live, you may use the Service only with the permission and supervision of a parent or legal guardian who can lawfully agree to these Terms for you.
The Service is not directed to children under 13. Do not submit a child's personal information, a prompt about an identifiable child, or content that a child is not legally permitted to provide. A parent or guardian who believes a child has provided information should use the privacy contact described in the Privacy Policy when it becomes available.
If you use the Service for a school, business, club, or other organization, you represent that you have authority to bind that organization and that your use complies with its policies and all laws that apply to it. The Service is not designed as an official examination, student-record, employment, credit, housing, medical, or other consequential decision system.
4. Accounts and account security
QuizTell accounts use Google sign-in. You must use only a Google account you are entitled to use, protect your session, and promptly report suspected unauthorized access. QuizTell does not issue a separate password. You are responsible for activity performed through your account until you notify us and we have a reasonable opportunity to act, except where applicable law provides otherwise.
You may not create accounts through automation, share credentials in a way that compromises security, impersonate another person, or create additional accounts to avoid a restriction, suspension, usage limit, consent choice, or abuse-prevention measure.
QuizTell synchronizes only Worker-verified completed permanent-library and Daily rounds, bounded recent history, aggregate scores and streaks, and bounded wrong-answer references. AI-generated rounds and in-progress answers remain browser-local. Self-service cloud-account deletion is not yet available.
5. What QuizTell provides
QuizTell provides a permanent subject library, date-specific Daily Quiz rounds, optional AI-generated rounds, multiple game modes and difficulty settings, explanations, scoring, progress displays, and browser-local backup and restore. The exact categories, questions, media, modes, rules, and features may change over time.
Permanent and Daily content is supplied as static site content. Dynamic features, including AI generation and any future account or contact delivery, require server-side providers and may be unavailable even when the rest of the Service works.
We grant you a limited, personal, revocable, non-exclusive, non-transferable right to access and use the Service for lawful entertainment and learning, subject to these Terms. This permission does not transfer ownership of the Service or any content and does not authorize resale, commercial exploitation, republication, or creation of a competing question database.
6. Game rules, scores, streaks, and virtual status
Standard, Timed, Survival, difficulty tiers, points, streaks, Daily completion, ranking labels, and features such as Double it operate according to the rules and controls displayed in the Service at the time you play. Displayed feature rules control over a general description elsewhere on the site for that round.
Scores, points, streaks, badges, player IDs, ranks, completion marks, and similar results are virtual records for entertainment. They have no cash value, are not property, are not redeemable, and do not create a right to a prize, payment, scholarship, credential, qualification, or ranking against other people.
We may correct, recalculate, remove, or invalidate a result affected by a content error, software defect, corrupted backup, manipulation, automation, abuse, or change in scoring rules. We do not promise that results from different versions, modes, devices, or question sets are directly comparable.
A Daily Quiz is determined by the date and current content version used by the Service. Time zones, browser dates, content corrections, or later releases may cause another user or device to receive a different experience.
7. AI Quiz and generated content
When you request an AI Quiz, QuizTell sends the topic or brief and selected difficulty through the QuizTell Worker to the configured model provider, currently DeepSeek, so the provider can generate a title and question set. The response is validated for the expected shape before it is shown, but structural validation does not prove factual accuracy or legal safety.
AI-generated questions, choices, answers, explanations, and titles may be false, incomplete, outdated, ambiguous, biased, offensive, repetitive, or similar to content produced for other users. A generated result is not reviewed by a human before delivery and does not express a statement, endorsement, or professional opinion by QuizTell or the model provider.
You must independently verify AI content before relying on or sharing it. Do not use AI Quiz as medical, legal, financial, safety, emergency, employment, credit, housing, education-admission, official assessment, or other professional or consequential advice. Do not take or omit an important action based only on a generated quiz.
AI Quiz depends on third-party availability, model behavior, capacity, location restrictions, and provider policies. A request may fail, time out, be refused, or produce an unusable result. We do not guarantee that the same prompt will return the same quiz or that AI Quiz will remain available.
8. Your prompts, submissions, and permissions
You retain any rights you have in an AI Quiz prompt, correction, feedback message, or other material you submit (“Your Content”). You are responsible for Your Content and for having every right, permission, and lawful basis needed to submit it and allow it to be processed as described in these Terms and the Privacy Policy.
You grant QuizTell and the service providers acting for QuizTell a worldwide, non-exclusive, limited license to host, transmit, reproduce, format, analyze, and otherwise process Your Content only as reasonably necessary to provide, secure, troubleshoot, and legally operate the requested feature. Provider-controlled processing is also subject to the provider's applicable terms and policies.
Do not submit passwords, API keys, authentication codes, payment details, confidential business information, health data, government identifiers, precise location, private information about another person, information about a child, or any other sensitive personal information in an AI Quiz prompt or ordinary feedback field.
You must not submit material that is unlawful, deceptive, threatening, exploitative, infringing, defamatory, privacy-invasive, malicious, or outside your authority to provide. You remain responsible for how you use, publish, or distribute generated output and for checking whether that use affects third-party rights.
To the extent permitted by applicable law and the model provider's terms, you may use the generated output you receive. Because generative systems can produce similar output for different users and can reproduce or resemble third-party material, we do not promise that output is unique, protectable, non-infringing, or exclusively yours.
9. Permanent questions, explanations, and corrections
Permanent questions are maintained as a structured content library with answers, difficulty information, and explanations. We use review and validation processes, but we do not guarantee that every question, translation, date, attribution, answer, or explanation is complete, current, or free from error.
Facts, accepted terminology, public records, boundaries, classifications, and expert consensus can change. Some questions simplify a topic for a short quiz format. Explanations are educational summaries, not exhaustive treatment of a subject.
We may correct a question, change an accepted answer, replace media, update an explanation, move content between topics, change difficulty, or retire content without preserving the previous version. A prior result does not give you a right to the continued availability of the same question or round.
If you report an error, include the quiz name, exact question, proposed correction, and a reliable source where possible. We may investigate and use the report, but submission does not guarantee a response, correction, attribution, or continued publication.
10. Images and third-party material
QuizTell may display licensed, public-domain, provider-generated, or otherwise authorized images, names, quotations, trademarks, and other third-party material. Attribution or source information may be displayed in the Service or maintained in project records where applicable.
The Service does not grant you ownership of third-party material or permission to extract, reuse, modify, or redistribute it. Your use outside the ordinary Service remains subject to the relevant copyright, trademark, publicity, database, contract, and license terms.
References to a person, place, organization, product, artwork, event, or trademark are for identification or quiz content and do not imply sponsorship, endorsement, affiliation, or approval.
If you believe content infringes your rights, use the Contact Us page when delivery is available and identify the work or right, the challenged content and location, your contact details, your basis for the claim, and any authority to act for the rights holder. We may request verification and may restrict content while a claim is assessed.
11. Acceptable use
You may use the Service only lawfully and in a manner that does not harm the Service, its users, providers, content owners, advertising partners, or other people.
- Do not violate law, another person's rights, these Terms, displayed feature rules, or a provider's applicable restrictions.
- Do not bypass authentication, age gates, consent controls, geographic restrictions, rate limits, access controls, or security measures.
- Do not introduce malware, exploit payloads, destructive code, unlawful instructions, or content intended to facilitate harm.
- Do not impersonate another person or organization, misrepresent authority, submit another person's private information without permission, or use forms for fraud, harassment, or spam.
- Do not manipulate scores, backups, Daily completion, advertising impressions or clicks, consent signals, provider usage, or measurement data.
- Do not use the Service to create or distribute professional advice, official assessments, discriminatory decisions, sexual content involving minors, violent wrongdoing, or other high-risk material.
- Do not interfere with another user's device or experience or impose an unreasonable load on the Service or its providers.
12. Automated access, scraping, and security testing
You may not use bots, scripts, crawlers, scrapers, browser automation, parallel requests, or other automated means to access dynamic endpoints, generate quizzes, create accounts, submit forms, harvest content, or evade ordinary user flows unless we have given prior written permission or applicable law clearly permits the activity despite this restriction.
Ordinary search-engine crawling of publicly indexable pages may be allowed according to published robots controls. Permission to crawl a page does not grant a license to copy the question database, media, explanations, branding, or generated results, and does not authorize access to non-public or dynamic endpoints.
Do not probe, scan, test, or attempt to exploit the Service or a provider without prior written authorization that states the scope and conditions. If you encounter a suspected vulnerability accidentally, stop testing, avoid accessing or changing data, preserve only the minimum evidence, and report it through an available contact channel.
We may apply technical limits, filtering, blocking, challenge mechanisms, or request logging to protect availability, security, provider quotas, users, and advertising integrity.
13. Browser-local progress and backups
QuizTell stores progress in your browser's local storage. Records may include a pseudonymous player ID, points, streaks, round counts, per-topic results, play counts, Daily completion, and recent round history. After Google sign-in, newly completed permanent-library and Daily rounds are also re-scored by the Worker and synchronized to the signed-in player's bounded cloud record.
Local progress can be lost or become unavailable if you clear site data, reset or replace the browser or device, use private browsing, disable storage, reach a storage limit, import a different backup, or encounter corruption or incompatible software. We do not promise recovery of browser-local data.
The Progress page may let you export a JSON backup and restore a structurally valid backup. A backup can contain your complete local QuizTell record and should be protected like other personal files. You are responsible for choosing where to save it, controlling who can access it, and confirming that an import is the file you intended to use.
Importing a valid backup replaces the current browser record with the imported record. Keep a separate copy if you may need the earlier state. We may reject malformed, unsupported, or incompatible files and are not responsible for edits made outside QuizTell.
Cloud synchronization does not replace a full local backup and may reject a round that cannot be matched to the current immutable content release. Local backup remains your responsibility unless the product expressly promises otherwise.
14. Advertising and advertising integrity
QuizTell may in the future be supported by contextual or personalized advertising, including services such as Google AdSense or AdX. Advertising is not active merely because it is described in these Terms or shown in a placeholder. The Privacy Policy and consent controls must reflect the actual advertising configuration before consent-dependent technologies are enabled.
Advertising providers may select, deliver, measure, limit, and protect ads and may process information under their own terms and privacy notices. Where required, QuizTell will request applicable choices before optional advertising storage, identifiers, or personalization and will provide a way to revisit those choices.
You must not click ads to support QuizTell, ask another person to click, refresh or automate pages to create impressions, disguise traffic, alter consent signals, interfere with measurement, or otherwise generate invalid activity. We may restrict access and cooperate with providers in investigating suspected invalid traffic or fraud.
An advertisement or sponsored destination is supplied by a third party. Unless expressly stated, QuizTell does not endorse or guarantee the advertiser, offer, destination, product, claim, availability, or transaction. Dealings with an advertiser are between you and that advertiser.
15. Third-party services and links
The Service may depend on third parties for hosting, content delivery, security, AI generation, authentication, database storage, email or contact delivery, consent management, analytics, advertising, fonts, media, or other functions. Those providers may apply their own terms, policies, limits, and availability rules.
A third-party outage, rate limit, policy change, model change, suspension, geographic restriction, security event, or discontinuation may delay, limit, alter, or disable a QuizTell feature. We are not responsible for a third party's independent service, site, content, promises, or handling of information, except to the extent applicable law makes us responsible.
Links to external sites are provided for convenience, attribution, reference, or advertising. You access them at your own risk and should review their terms and privacy notices. We do not control an external site's content, security, accessibility, cookies, transactions, or continued availability.
16. QuizTell intellectual property
The Service, including its software, interface, original editorial text, selection and arrangement, visual design, branding, icons, and original question compilation, is owned by or licensed to the Service operator and is protected by applicable intellectual-property and other laws.
Except for the limited right to use the Service under these Terms, no right or license is granted by implication, estoppel, or otherwise. You may not copy, reproduce, republish, sell, sublicense, distribute, frame, mirror, extract, reverse engineer, decompile, create a substitute database from, or remove proprietary notices from the Service except where applicable law does not permit that restriction.
You may share ordinary links to public QuizTell pages and may refer to your own scores in a truthful, non-misleading way. You may not imply sponsorship, partnership, certification, or endorsement by QuizTell or use QuizTell branding in a way likely to cause confusion.
17. Feedback and suggestions
If you submit a correction, suggestion, idea, design proposal, survey response, or other feedback, you grant QuizTell a perpetual, worldwide, non-exclusive, transferable, sublicensable, royalty-free license to use, reproduce, modify, publish, and incorporate that feedback for operating, correcting, securing, and improving the Service without payment or attribution.
This feedback license does not transfer ownership of personal information contained in a submission and does not override the Privacy Policy. Do not include confidential information or material you are not authorized to license.
Submitting feedback does not require us to review, respond, adopt, credit, or preserve it and does not create a confidential, fiduciary, employment, or partnership relationship.
18. Availability, maintenance, and changes to the Service
The Service is provided on an evolving and availability-dependent basis. We do not promise uninterrupted operation, a particular uptime, compatibility with every device or browser, preservation of every result, continued access to every question, or availability of any specific feature, provider, model, category, mode, or interface.
We may test, maintain, update, correct, redesign, restrict, suspend, replace, or discontinue any part of the Service. Reasons may include security, abuse, provider availability, legal requirements, rights claims, cost, capacity, technical limits, content quality, accessibility, or product decisions.
Where reasonably practicable and legally required, we will provide notice of a material change that adversely affects an enabled account or paid entitlement. QuizTell currently does not promise permanent hosting of browser-local results or advance notice before changing free content.
You are responsible for exporting local progress you want to retain and for keeping compatible devices, browsers, connections, and software. We may release updates that make an older backup, link, browser, or integration incompatible where reasonably necessary.
19. Suspension and termination
We may restrict, suspend, or terminate access to all or part of the Service when we reasonably believe it is necessary to address a Terms violation, unlawful conduct, security threat, invalid advertising activity, fraud, provider requirement, legal obligation, rights claim, repeated excessive use, or material harm to the Service or another person.
Where appropriate, a restriction may include rejecting requests, blocking a network or device, invalidating a session, disabling an account or API-dependent feature, removing submitted material, preserving relevant records, or preventing re-registration. We may act without advance notice when delay could increase risk or when a provider or legal authority requires immediate action.
You may stop using the Service at any time. Removing browser-local data requires clearing the relevant site data or replacing it through the product's controls. Closing a future account will be governed by the procedures then displayed and will not necessarily delete security, legal, dispute, or other records that must be retained.
Sections that by their nature should survive termination remain effective, including provisions concerning intellectual property, submitted-content permissions already exercised, disclaimers, liability, disputes, and general terms.
20. Disclaimers
To the maximum extent permitted by applicable law, the Service and all questions, answers, explanations, images, scores, generated output, links, and features are provided “as is” and “as available.” We disclaim express, implied, and statutory warranties, including accuracy, completeness, availability, merchantability, satisfactory quality, fitness for a particular purpose, title, quiet enjoyment, and non-infringement.
We do not warrant that the Service will meet your requirements; that access will be uninterrupted, timely, secure, or error-free; that defects will be corrected; that content will remain available or unchanged; or that any result will be accurate, unique, current, or suitable for a decision.
QuizTell is for general entertainment and informal learning. It is not a school, testing authority, credentialing organization, professional adviser, emergency service, or source of guaranteed facts. You assume responsibility for checking content and deciding whether and how to use it.
Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, the exclusions apply only to the extent permitted and do not remove rights that cannot legally be waived.
21. Limitation of liability
To the maximum extent permitted by applicable law, QuizTell and the Service operator, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages, or for loss of data, progress, opportunity, goodwill, profits, revenue, or business, arising from or related to the Service, even if advised that such loss is possible.
To the maximum extent permitted by law, we are not liable for harm arising from inaccurate or generated content; reliance on an answer or explanation; loss or corruption of browser-local records or backups; third-party services or links; unauthorized account or device access; provider outages; changes to content or scoring; or conduct of another user or advertiser.
Where liability cannot be excluded, our aggregate liability for claims arising from the free Service will not exceed the greater of the amount you paid directly to QuizTell for the feature giving rise to the claim during the 12 months before the event or US$50. Because QuizTell currently offers no paid end-user feature, that amount will ordinarily be US$50, subject always to any higher non-waivable remedy required by law.
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, willful misconduct, gross negligence where it cannot be limited, death or personal injury caused by negligence where it cannot be limited, or any other liability or statutory right that applicable law does not permit us to exclude or limit.
22. Responsibility for organizational and unlawful use
If you use the Service on behalf of an organization, then to the extent permitted by law, that organization will defend, indemnify, and hold harmless the Service operator and its affiliates, licensors, and providers from third-party claims, losses, liabilities, and reasonable costs arising from the organization's Your Content, violation of these Terms, violation of law, or infringement of another person's rights.
This section does not require an individual consumer to indemnify QuizTell where such an obligation would be prohibited or unfair under applicable consumer law. We reserve the right to control the defense and settlement of an indemnified claim, and the organization may not settle a claim in a way that admits fault or imposes obligations on us without written consent.
23. Mandatory consumer rights
These Terms do not limit rights or remedies that cannot legally be waived, including mandatory consumer guarantees, privacy rights, rights concerning unfair contract terms, or remedies for our unlawful conduct. If a mandatory rule conflicts with these Terms, the mandatory rule controls only to the extent of the conflict.
Any language stating “to the maximum extent permitted by law,” “where permitted,” or similar wording is intended to preserve those mandatory rights. Nothing in these Terms requires you to give up a right before a dispute arises where applicable law does not allow that waiver.
The Service may not be available or lawful in every location. You are responsible for determining whether your access and intended use are permitted where you are located, but that responsibility does not remove obligations that applicable law places on us.
24. Disputes and governing principles
Before starting formal proceedings, you and QuizTell should make a reasonable good-faith effort to describe the dispute and requested resolution through an available contact method and allow a reasonable opportunity to respond. This informal step is not required where urgent relief is needed, a limitation period may expire, a contact method is unavailable, or applicable law gives you an immediate right to proceed.
These Terms are governed by the law that lawfully applies to the Service operator and the relevant transaction, without displacing mandatory consumer protections that apply in your place of residence. A dispute may be brought only before a court or tribunal that has lawful jurisdiction over the parties and subject matter.
These Terms do not create a mandatory arbitration agreement, jury-trial waiver, or class-action waiver. If the operator later proposes one, it must appear in a revised agreement and will apply only after any notice, consent, and enforceability requirements are met.
25. Changes to these Terms and general provisions
We may revise these Terms when the Service, providers, risks, business model, or legal requirements change. The posted version and Last Updated date identify the current Terms. Where required, we will give additional notice or request renewed acceptance before a material change takes effect.
Changes apply prospectively from their stated effective date. If you do not agree to revised Terms, stop using the affected Service. Continued use after the effective date constitutes acceptance only where applicable law permits that method of acceptance.
These Terms, the Privacy Policy, and any applicable feature-specific rules form the entire agreement concerning the Service and replace earlier agreements on the same subject. If a provision is unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions will continue in effect.
Our failure to enforce a provision is not a waiver. You may not assign or transfer these Terms or an account without prior written consent. We may assign these Terms as part of a merger, reorganization, sale, or transfer of the Service, subject to applicable law and the Privacy Policy.
Headings are for convenience and do not narrow a provision. Words such as “including” mean “including without limitation.” Electronic notices and records may be used where permitted by law. Questions about these Terms may be sent through the Contact Us page when delivery is confirmed available.
